Fundamental values such as freedom and equality govern interactions between citizens and Member States through binding norms. These norms are based on treaties that establish their competencies and ensure the primacy of EU law over national legislations.<\/p>\n\n\n\n<p>EU law has direct effect, allowing citizens and businesses to invoke European norms in national courts. The Court of Justice of the EU ensures the uniform interpretation and application of these norms. This system is dynamic and continuously evolves to strengthen integration among Member States.<\/p>\n\n\n\n<p>The legal order of the European Union is a unique system resulting from the integration of national laws of Member States into a supranational framework and can be viewed from two perspectives: it is a creation of law and it is a legal order. O tribunal analisou a compatibilidade da legisla\u00e7\u00e3o austr\u00edaca com o direito da Uni\u00e3o Europeia em rela\u00e7\u00e3o ao acesso da pol\u00edcia a dados pessoais armazenados em dispositivos m\u00f3veis, no presente caso, um celular.&nbsp;<\/p>\n\n\n\n<p>O ac\u00f3rd\u00e3o estabelece que, embora o acesso da pol\u00edcia a esses dados possa ser justificado por raz\u00f5es de investiga\u00e7\u00e3o criminal, a inger\u00eancia nos direitos fundamentais do titular dos dados deve ser proporcional e car\u00e1ter excepcional.&nbsp;<\/p>\n\n\n\n<p>O tribunal conclui que a legisla\u00e7\u00e3o austr\u00edaca deve definir os elementos a considerar para autorizar o acesso, como a natureza das infra\u00e7\u00f5es em causa, e que esse acesso deve ser autorizado previamente por um tribunal ou autoridade independente, exceto em casos de urg\u00eancia devidamente justificada. The court analyzed the compatibility of Austrian law with European Union law regarding police access to personal data stored on mobile devices, in this case, a cell phone. The judgment establishes that while police access to this data may be justified for criminal investigation purposes, any interference with the fundamental rights of the data subject must be proportional and exceptional. The court concluded that Austrian legislation must define the elements to consider for authorizing access, such as the nature of the offenses in question, and that such access must be previously authorized by a court or an independent authority, except in cases of duly justified urgency. The data subject must be informed of the reasons for the authorization as soon as possible, without compromising the investigation.<\/p>\n\n\n\n<p>Further on this topic, emphasis is placed on prior authorization, meaning that prior approval from a judge or an independent authority is essential for data access, except in cases of duly justified urgency. SLOVAKIA PELO TRIBUNAL EUROPEU DE DIREITOS HUMANOS<\/strong><\/a><\/p>\n\n\n\n<p><strong>Nat\u00e1lia Marques Andrade<\/strong><\/p>\n\n\n\n<p>No dia 24 de outubro de 2024, o Tribunal Europeu de Direitos Humanos (TEDH) julgou o caso B.B. v. Slovakia, referente a um caso de viola\u00e7\u00e3o do Artigo 4 da Conven\u00e7\u00e3o Europeia de Direitos Humanos, que pro\u00edbe a escravid\u00e3o e o trabalho for\u00e7ado.<\/p>\n\n\n\n<p>Neste caso, a v\u00edtima, identificada como B.B., uma cidad\u00e3 eslovaca, foi enviada ao Reino Unido no ano de 2010 por um indiv\u00edduo identificado como Y, para realizar trabalho for\u00e7ado de prostitui\u00e7\u00e3o. Durante um ano, a v\u00edtima foi obrigada a se prostituir, entregar seus ganhos e cuidar da casa do acusado, enquanto era mantida sob o efeito de drogas.<\/p>\n\n\n\n<p>No ano de 2012, B.B. foi acolhida pelo Ex\u00e9rcito da Salva\u00e7\u00e3o no Reino Unido e retornou \u00e0 Eslov\u00e1quia atrav\u00e9s de um programa destinado a apoiar e proteger v\u00edtimas de tr\u00e1fico humano. Ao chegar, foi registrada como v\u00edtima de tr\u00e1fico humano por uma organiza\u00e7\u00e3o de caridade apoiada pelo governo, mas as autoridades mudaram a classifica\u00e7\u00e3o do caso para proxenetismo quando Y foi acusado. A investiga\u00e7\u00e3o policial falhou em considerar as evid\u00eancias que indicavam tr\u00e1fico humano, limitando-se a tratar o caso como proxenetismo.
