Despite Switzerland&#8217;s actions, which are far from being on track to meet the goals set in the Paris Agreement, a majority of voters reject ECHR interventions, believing that the country is already doing enough to mitigate environmental damage.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision to comply with the court&#8217;s ruling lies with the Swiss government, which will announce its verdict in August. Tal fato pode se dar caso a organiza\u00e7\u00e3o n\u00e3o conseguir mais garantir condi\u00e7\u00f5es de vida digna ou seguran\u00e7a m\u00ednima a esses indiv\u00edduos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tal movimenta\u00e7\u00e3o se deu in\u00edcio quando em 2018 m\u00e3e e filha sem nacionalidade de origem palestina deixaram Gaza, entrando de maneira irregular na Bulg\u00e1ria, tendo suas solicita\u00e7\u00f5es de prote\u00e7\u00e3o internacional rejeitadas por terem deixado voluntariamente a \u00e1rea da UNRWA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O tribunal b\u00falgaro ent\u00e3o solicitou ao Tribunal de Justi\u00e7a da UE que interprete a Diretiva de Procedimentos e a Diretiva de Qualifica\u00e7\u00f5es, as quais, via de regra, excluem os registrados na UNRWA do&nbsp;<em>status<\/em>&nbsp;de refugiado na UE, a n\u00e3o ser que a prote\u00e7\u00e3o da institui\u00e7\u00e3o tenha findado.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O Tribunal de Justi\u00e7a afirma que tal an\u00e1lise deveria considerar todos os fatos pertinentes, inclusive aqueles que j\u00e1 haviam sido processados. This issue arose when, in 2018, a mother and her stateless Palestinian-origin daughter left Gaza and entered Bulgaria illegally, with their requests for international protection being rejected due to their voluntary departure from the UNRWA area.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bulgarian court subsequently asked the Court of Justice of the EU to interpret the Procedures Directive and the Qualification Directive, which typically exclude those registered with UNRWA from refugee status in the EU unless UNRWA&#8217;s protection has ended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of Justice stated that such an assessment should consider all relevant facts, including those already processed. O plano em quest\u00e3o inclui dez elementos essenciais: um sistema comum de informa\u00e7\u00e3o (Eurodac) para aplicar novas regras de solidariedade e responsabilidade; gest\u00e3o da migra\u00e7\u00e3o nas fronteiras externas; condi\u00e7\u00f5es de acolhimento adequadas; procedimentos de asilo justos e eficientes; procedimentos de regresso eficientes; um sistema justo para partilha de responsabilidades; solidariedade funcional; prepara\u00e7\u00e3o e resposta a crises; novas salvaguardas para prote\u00e7\u00e3o dos direitos fundamentais; e esfor\u00e7os de reinstala\u00e7\u00e3o e integra\u00e7\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O Pacto, adotado em 2024, pelo Parlamento Europeu e pelo Conselho, visa gerir a migra\u00e7\u00e3o de forma justa e sustent\u00e1vel, garantindo, assim, a solidariedade entre os pa\u00edses da UE e prote\u00e7\u00e3o dos direitos dos migrantes. Seus elementos-chave incluem apoio a Estados-Membros sob press\u00e3o e efici\u00eancia nos procedimentos de gest\u00e3o de fronteiras e asilo. Para apoiar a implementa\u00e7\u00e3o do Pacto, a Comiss\u00e3o apresentou um Plano de Implementa\u00e7\u00e3o Comum, base para os Planos Nacionais dos Estados-Membros, com medidas operacionais imediatas, incluindo planos de a\u00e7\u00e3o focados em rotas migrat\u00f3rias espec\u00edficas e parcerias com Tun\u00edsia, Egito e Maurit\u00e2nia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em setembro de 2020, a Comiss\u00e3o Europeia apresentou o Pacto sobre Migra\u00e7\u00e3o e Asilo, propondo um sistema comum para a gest\u00e3o de migra\u00e7\u00e3o na UE. Ap\u00f3s intensas negocia\u00e7\u00f5es, o Parlamento Europeu e o Conselho chegaram a um acordo pol\u00edtico em dezembro de 2023. O pacto entrou em vigor em junho de 2024, com a expectativa de que os Estados-Membros implementem as capacidades necess\u00e1rias at\u00e9 2026, com suporte da Comiss\u00e3o e ag\u00eancias da UE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As novas regras visam uma gest\u00e3o robusta da migra\u00e7\u00e3o e asilo, incluindo procedimentos fronteiri\u00e7os mais r\u00e1pidos, partilha de responsabilidade e solidariedade entre os Estados-Membros. Clarificam-se crit\u00e9rios para prote\u00e7\u00e3o internacional, direitos dos refugiados e introduzem-se san\u00e7\u00f5es para movimentos n\u00e3o autorizados. A UE tamb\u00e9m investe em vias legais de migra\u00e7\u00e3o e parcerias de talentos, como com Marrocos e Bangladesh, para trabalho, estudo e treinamento na UE. Propostas incluem um Banco de Talentos da UE para conectar empregadores a candidatos internacionais e fortalecer ag\u00eancias como a Frontex e a Ag\u00eancia da UE para o Asilo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Medidas operacionais concretas abarcam planos de a\u00e7\u00e3o para rotas migrat\u00f3rias como o Mediterr\u00e2neo Central e os Balc\u00e3s Ocidentais. E em mar\u00e7o de 2022, a Diretiva de Prote\u00e7\u00e3o Tempor\u00e1ria foi ativada para proteger refugiados da guerra na Ucr\u00e2nia. Currently, the Commission is working on the application of the new rules, requiring Member States to submit their national plans by the end of 2024. This plan includes ten essential elements: a common information system (Eurodac) to apply new rules of solidarity and responsibility; management of migration at external borders; adequate reception conditions; fair and efficient asylum procedures; efficient return procedures; a fair system for sharing responsibilities; functional solidarity; preparation and response to crises; new safeguards for the protection of fundamental rights; and efforts for resettlement and integration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pact, adopted in 2024 by the European Parliament and the Council, aims to manage migration fairly and sustainably, thus ensuring solidarity among EU countries and protecting migrants&#8217; rights. Key elements include support for Member States under pressure and efficiency in border and asylum management procedures. To support the implementation of the Pact, the Commission presented a Joint Implementation Plan, which serves as a basis for Member States&#8217; National Plans, with immediate operational measures, including action plans focused on specific migration routes and partnerships with Tunisia, Egypt, and Mauritania.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In September 2020, the European Commission presented the Migration and Asylum Pact, proposing a common system for managing migration in the EU. After intense negotiations, the European Parliament and the Council reached a political agreement in December 2023. The pact came into force in June 2024, with the expectation that Member States will implement the necessary capacities by 2026, with support from the Commission and EU agencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new rules aim for robust migration and asylum management, including faster border procedures, responsibility sharing, and solidarity among Member States. Criteria for international protection and refugee rights are clarified, and sanctions for unauthorized movements are introduced. The EU is also investing in legal migration pathways and talent partnerships, such as with Morocco and Bangladesh, for work, study, and training in the EU. Proposals include an EU Talent Pool to connect employers with international candidates and strengthen agencies like Frontex and the EU Asylum Agency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concrete operational measures include action plans for migration routes such as the Central Mediterranean and the Western Balkans. In March 2022, the Temporary Protection Directive was activated to protect refugees from the war in Ukraine. These events were crucial for discussing the recommendations of the Maria da Penha Case, emphasizing the importance of ongoing dialogue on democracy and human rights. The delegation, led by Roberta Clarke, reinforced the commitment to the precautionary measure MC-449-22, highlighting the relevance of such measures for the protection of human rights.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In December of last year, a Joint Working Table was established along with the launch of the Action Plan for the implementation of the precautionary measures MC-449-22 by the Ministry of Foreign Affairs, actions carried out on December 11 of last year focusing on the three cases. These measures, which were expanded in October 2022 to include representatives from the Union of Indigenous Peoples of the Javari Valley (UNIVAJA), aim to ensure safety and justice for those threatened by their protective work. The Action Plan, lasting two years, was jointly developed by the Brazilian state, representatives of the beneficiaries, and the IACHR, emphasizing coordinated actions across three main axes: direct protection of the beneficiaries, non-repetition measures, and international cooperation.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the recent IACHR visit to Brazil, in addition to the memorial events, the IACHR conducted training focused on social participation in international human rights mechanisms. These trainings aim to strengthen civil society involvement and ensure that community voices are heard on global platforms. Effective societal participation is seen as an essential pillar for the promotion and observance of human rights in the region.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The visit also included a specific event on social participation, where the IACHR could highlight its essential role in promoting the observance of human rights. This interaction between the IACHR and the participants reinforces the importance of such events to ensure that international human rights guidelines are not only discussed but effectively implemented.
