Decidiu que a falta de a\u00e7\u00e3o do governo violou os seus direitos humanos fundamentais. Na mesma ocasi\u00e3o, foram rejeitados outros dois pedidos semelhantes por quest\u00f5es meramente t\u00e9cnicas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O Tribunal de Estrasburgo declarou que o artigo 8.\u00ba da Conven\u00e7\u00e3o Europeia dos Direitos Humanos abrange o direito \u00e0 prote\u00e7\u00e3o efetiva por parte do Estado \u201ccontra os graves efeitos adversos das altera\u00e7\u00f5es clim\u00e1ticas na vida, na sa\u00fade, no bem-estar e na qualidade de vida\u201d.&nbsp;A senten\u00e7a no caso das mulheres su\u00ed\u00e7as estabelece um precedente para futuros lit\u00edgios clim\u00e1ticos, inclusive nos seis casos ainda pendentes de julgamento.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Especialistas entendem que tal precedente pode desencadear diversos novos lit\u00edgios clim\u00e1ticos em toda a Europa, de modo a for\u00e7ar os governos europeus em suas pol\u00edticas voltadas \u00e0s responsabilidades clim\u00e1ticas em garantir um ambiente saud\u00e1vel.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Percebe-se que se fortalece o entendimento que a prote\u00e7\u00e3o contra crises clim\u00e1ticas tamb\u00e9m \u00e9 um direito humano a ser protegido por todos os pa\u00edses. Ademais, o julgado levantou a quest\u00e3o sobre o papel do direito internacional, como o Acordo de Paris, na determina\u00e7\u00e3o do que \u00e9 uma a\u00e7\u00e3o clim\u00e1tica adequada.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Se pensarmos a respeito no contexto brasileiro, os recentes epis\u00f3dios no estado do Rio Grande do Sul e em algumas cidades do estado do Maranh\u00e3o demonstram que, incluindo principalmente outras regi\u00f5es do sul global, os impactos da crise j\u00e1 s\u00e3o sentidos. It ruled that the government&#8217;s lack of action violated their fundamental human rights. At the same time, two similar requests were rejected on purely technical grounds.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Strasbourg Court declared that Article 8 of the European Convention on Human Rights encompasses the right to effective protection from the state &#8220;against the serious adverse effects of climate change on life, health, well-being, and quality of life.&#8221; The verdict in the Swiss women&#8217;s case sets a precedent for future climate litigation, including the six cases still pending.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Experts believe that such a precedent could trigger various new climate litigations across Europe, compelling European governments to adopt policies aimed at climate responsibilities to ensure a healthy environment.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is evident that the understanding that protection against climate crises is also a human right protected by all countries is strengthening. Besides, the ruling raised questions about the role of international law, such as the Paris Agreement, in determining what constitutes adequate climate action.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If we consider Brazil, recent events in the state of Rio Grande do Sul and some cities in the state of Maranh\u00e3o demonstrate that, including mainly other regions of the global South, the impacts of the crisis are already being felt. SU\u00cd\u00c7A<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Val\u00e9ria Em\u00edlia De Aquino<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;No dia 09 de Abril de 2024, a Corte Europeia de Direitos Humanos publicou a senten\u00e7a do&nbsp;<a href=\"https:\/\/www.globalcrossings.com.br\/en\/2023\/10\/26\/projeto-clobal-crossings\/\">Caso KlimaSeniorinnnen e outros vs. Su\u00ed\u00e7a<\/a>, reconhecendo a viola\u00e7\u00e3o da obriga\u00e7\u00e3o de respeitar os direitos \u00e0 vida privada e familiar (Art. 8 da Conven\u00e7\u00e3o), bem como a viola\u00e7\u00e3o de acesso \u00e0 corte (Art. 6,&nbsp;\u00a7 1). A Corte entendeu que o art. 8 abrange o direito \u00e0 efetiva prote\u00e7\u00e3o pelo Estado contra os adversos efeitos das mudan\u00e7as clim\u00e1ticas sob a vida, sa\u00fade, bem-estar e qualidade de vida, concluindo que a Su\u00ed\u00e7a falhou no seu dever respeitar estas obriga\u00e7\u00f5es, em raz\u00e3o das lacunas no estabelecimento de um regulamento nacional relevante para reduzir as emiss\u00f5es nacionais de gases de efeito estufa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Al\u00e9m disso, tamb\u00e9m foi apontado que o pa\u00eds n\u00e3o conseguiu cumprir as suas metas anteriores de redu\u00e7\u00e3o, e, ainda que tivesse discricionariedade para a implementa\u00e7\u00e3o de legisla\u00e7\u00e3o e de medidas de mitiga\u00e7\u00e3o relevantes, a Corte entendeu que as autoridades su\u00ed\u00e7as n\u00e3o agiram tempestivamente de maneira apropriada a conceber, desenvolver e implementar uma efetiva legisla\u00e7\u00e3o e medidas relevantes para tal prop\u00f3sito.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;No que concerne ao art. 6\u00ba, \u00a7 1 da Conven\u00e7\u00e3o, a Corte reconheceu o&nbsp;<em>status&nbsp;<\/em>de v\u00edtima das requerentes e entendeu pela aplicabilidade deste dispositivo, visto que dizia respeito \u00e0 implementa\u00e7\u00e3o&nbsp;eficaz das medidas de mitiga\u00e7\u00e3o \u00e0 luz da legisla\u00e7\u00e3o existente, reiterando a especial relev\u00e2ncia da a\u00e7\u00e3o coletiva no contexto das altera\u00e7\u00f5es clim\u00e1ticas. Por fim, a Corte concluiu que a rejei\u00e7\u00e3o da a\u00e7\u00e3o judicial da associa\u00e7\u00e3o requerente, primeiro por uma autoridade administrativa, denominada \u201cDETEC\u201d, e depois pelos tribunais nacionais em dois n\u00edveis de jurisdi\u00e7\u00e3o, constitu\u00eda uma interfer\u00eancia no seu direito de acesso a um tribunal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>REFER\u00caNCIAS:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ECHR. SU\u00cd\u00c7A<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Val\u00e9ria Em\u00edlia De Aquino<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 9, 2024, the European Court of Human Rights published the ruling in the Case of KlimaSeniorinnnen and others vs. Switzerland, recognizing the violation of the obligation to respect the rights to private and family life (Art. 8 of the Convention), as well as the violation of access to the court (Art. 6, \u00a7 1). The Court understood that art. 8 covers the right to effective protection by the State against the adverse effects of climate change on life, health, well-being and quality of life, concluding that Switzerland failed in its duty to respect these obligations, due to gaps in the establishment of a relevant national regulation to reduce national greenhouse gas emissions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, it was also pointed out that the country was unable to meet its previous reduction targets, and, even though it had discretion to implement relevant legislation and mitigation measures, the Court understood that the Swiss authorities did not act in a timely and appropriate manner to design, develop and implement effective legislation and relevant measures for this purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As regards art. 6, \u00a7 1 of the Convention, the Court recognized the victim status of the applicants and understood the applicability of this provision, as it concerned the effective implementation of mitigation measures in light of existing legislation, reiterating the special relevance of collective action in the context of climate change.
